1. ABOUT THE SITE

As used on the Site, "you" or "your" or "user" refers to you or a user of the Site; and "we" or "our" refers to Gunston Hall Realty, Inc. or its authorized agent(s) or authorized representative(s).

Accessing this Site is an acknowledgement by the user that the user agrees to or can agree to these Terms of Use.  If you do not or cannot agree to these Terms of Use, you may not access or use the Site.

This Site provides only general information about the apartments, their location, their square footage, their floor plans, their typical rent as may be charged for the respective apartments, and other general information as may be provided on the Site; and, as such, this general information should not be relied upon by you and no representation is made that such general information is exact, accurate or binding upon Gunston Hall Realty, Inc..

The outside appearance of Gunston Hall Apartments is subject to change or may have been changed from that as may be illustrated and described on the Site, such as due to changes in landscaping or other changes to the exterior of the buildings, and the appearance of the interior of the buildings and apartments is also subject to change or may have been changed from that illustrated and described on the Site, and such general information as to inside or outside appearance or landscaping should not be relied upon by you and no representation is made that such general information is exact, accurate or binding upon Gunston Hall Realty, Inc..  If an amount of rent is stated on the Site for an apartment, such amount of rent should be considered as an approximation of the rent for general information only and is not and should not be considered binding on Gunston Hall Apartments, Inc..  Also, Gunston Hall realty, Inc. reserves the right to increase or modify the rent, as well as what is included or excluded in the rent, at any time without notice.

This Site may provide residents of Gunston Hall Apartments a link to submit maintenance requests online electronically.  Such submission of a maintenance request online signifies your agreement to these Terms of Use; and such electronic online submission of a maintenance request is not considered submitted and received until acknowledged by Gunston Hall Apartments, Inc.

This Site may allow users to download an application for an apartment.  Downloading and/or submitting an application for an apartment is no guarantee of your qualifying for an apartment or that an apartment is available for rent.  You must be at least 18 years old to apply for an apartment and have sufficient income to pay the rent, as well as meet other requirements as stated in the application or for qualification.  Downloading of an application for an apartment or downloading any other document that may be provided on this Site signifies your agreement to these Terms of Use.

2. PRIVACY POLICY

Gunston Hall Apartments, Inc. respects the privacy of its Site users.  Please refer to the Privacy Policy link which explains how we collect, use, and disclose information that pertains to your privacy.  When you access or use the Site, you signify your agreement to this Privacy Policy.

3. USE AND CONDUCT RESTRICTIONS

Your permission to use the Site is conditioned upon your abiding by the following Use and Conduct Restrictions.

You agree that you will not under any circumstances:

  1. use the Site for any unlawful purpose or for the promotion of illegal activities;
  2. attempt to, or harass, abuse or harm another person or group;

6. COPYRIGHT COMPLAINTS AND COPYRIGHT AGENT

(a) Termination of Repeat Infringer Accounts
Gunston Hall Apartments, Inc. respects the intellectual property rights of others and requests that the users of this Site do the same.  Pursuant to 17 U.S.C. 512(i) of the United States Copyright Act, Gunston Hall Apartments, Inc. has adopted and implemented a policy that provides for the termination in appropriate circumstances of users of the Site who are repeat infringers.  Gunston Hall Apartments, Inc. may terminate access for users who are found repeatedly to provide protected third party content without necessary rights and permissions.

All content on this Site, including but not limited to design, text, software, technical drawings, configurations, graphics, electronic files, and their selection and arrangement (individually and collectively considered as the "Content"), are, unless indicated otherwise, either Copyrighted by Gunston Hall Apartments, Inc., or are the proprietary property of Gunston Hall Apartments, Inc. or its affiliates or licensors.  All rights reserved.  The Content may not be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without Gunston Hall Apartments, Inc.'s express written permission.  Please note that this limited consent, if granted, can be revoked at any time and does not include consent to republish Content on any Internet, Intranet, Extranet, or any general Forum site or to incorporate the information in any other database or compilation.  Any other use of the Content is strictly prohibited.

MAKES NO WARRANTY OR REPRESENTATION THAT ACCESS TO OR OPERATION OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE.  YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, CONTENT OR OTHER MATERIAL OBTAINED FROM THE SITE OR ANY THIRD PARTY SITES LINKED TO THIS SITE.  SOME JURISDICTIONS LIMIT OR DO NOT PERMIT DISCLAIMERS OF WARRANTY, SO THIS PROVISION MAY NOT APPLY TO YOU.

10. LIMITATION OF DAMAGES; RELEASE

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUNSTON HALL APARTMENTS, INC., ITS AFFILIATES, DIRECTORS, OFFICERS, AGENTS OR EMPLOYEES, OR ITS LICENSORS OR PARTNERS, BE LIABLE TO YOU ANYONE ELSE, OR ANY ENTITY FOR ANY LOSS OF PROFITS, USE, OR DATA, OR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, HOWEVER ARISING, THAT RESULT FROM (A) YOUR USE OR INABILITY TO USE THE SITE; (B) THE SITE GENERALLY OR THE SOFTWARE OR SYSTEMS THAT MAKE THE SITE AVAILABLE; OR (C) ANY OTHER INTERACTIONS WITH GUNSTON HALL APARTMENTS, INC. OR ANY OTHER USER OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT GUNSTON HALL APARTMENTS, INC. HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.  SOME JURISDICTIONS LIMIT OR DO NOT PERMIT DISCLAIMERS OF LIABILITY, SO THIS PROVISION MAY NOT APPLY TO YOU.

If you have a dispute with one or more users, a restaurant or a merchant of a product or a Third Party Site that you review or access using the Site, you release us (and our officers, directors, agents, representatives, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.  If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

11. MODIFICATION OF TERMS OF USE

We can amend these Terms of Use at any time and will update these Terms of Use in the event of any such amendments.  It is your sole responsibility to check the Site from time to time to view any such changes in the Terms of Use and the Agreement.  If you continue to use the Site, you signify your agreement to our revisions to these Terms of Use.  However, we will notify you of material changes to the Terms of Use by posting a notice on our homepage.  Any changes to these Terms of Use (other than as set forth in this paragraph) or waiver of Gunston Hall Apartments, Inc.'s rights hereunder shall not be valid or effective except in a written agreement bearing the physical signature of an officer of Gunston Hall Apartments, Inc.  No purported waiver or modification of these Terms of Use and the Agreement by Gunston Hall Apartments, Inc. via telephonic or email communications shall be valid.

Gunston Hall Apartments, Inc. reserves the right to terminate, change, suspend or discontinue any aspect of the Site, including the availability of any features, at any time and without further notice.  Gunston Hall Apartments, Inc. further reserves the right to remove, modify or otherwise change any content, including that of third parties, on or from this Site at any time and without further notice.  Gunston Hall Apartments, Inc. can also impose limits on certain features and services or can restrict access to any part of the Site, including the entire Site.  Gunston Hall Apartments, Inc. can terminate a user's use of the Site or can terminate the Site itself, at any time in its sole discretion and without further notice.

12. GENERAL TERMS

If any part of this Agreement is held invalid or unenforceable, that portion of the Agreement will be construed consistent with applicable law.  The remaining portions will remain in full force and effect.  Any failure on the part of Gunston Hall Apartments, Inc. to enforce any provision of this Agreement will not be considered a waiver of our right to enforce such provision.  Our rights under this Agreement will survive any termination of this Agreement.  You agree that any cause of action related to or arising out of your relationship with Gunston Hall Apartments, Inc. related to use or access of the Site must commence within ONE (1) year after the cause of action accrues.  Otherwise, such cause of action is permanently barred.  These Terms of Use and your use of the Site are governed by the federal laws of the United States of America and the laws of the Commonwealth of Virginia, without regard to conflict of law provisions.  Gunston Hall Apartments, Inc. may assign or delegate these Terms of Use for the Site and/or Gunston Hall Apartments, Inc.'s Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent.  You may not assign or delegate any rights or obligations under the Terms of Use of the Site or the Privacy Policy without Gunston Hall Apartments, Inc.'s prior written consent, and any unauthorized assignment and delegation by you is void.

YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THE TERMS OF USE, AND WILL BE BOUND BY THESE TERMS OF USE AND CONDITIONS.  YOU FURTHER ACKNOWLEDGE THAT THESE TERMS OF USE TOGETHER WITH THE PRIVACY POLICY REPRESENT THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US AND THAT IT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
